On 27 July 2023, the Baku City Sabunchu District Court issued a ruling: to apply a preventive measure against Elkhan Aliyev in the form of arrest for a period of 3 months.
The period of detention in custody during the investigation has been subsequently extended several times Sentence: On 1 April 2024, the Baku Court for Serious Crimes issued a verdict: to find Agalar Agaev guilty on all charges and sentenced him to 5 years imprisonment with serving the sentence in a general regime penal institution.

Yusif Aliyev and Vafadar Akhundov were also detained along with Aliyev, as said in the press service of the Ministry of Internal Affairs.
According to the MIA version, all three of them were suspected of selling a land plot in Nardaran settlement using the forged documents.
Prior to his detention, Aliyev released a video in which he spoke of a possible provocation against him.
According to the lawyer, Neimat Karimli, his client denied the accusation and declared that his arrest was of a political nature: "Elkhan Aliyev said that the accusation had been trumped up.
He did not commit the offences he was accused of.
The investigation did not provide the initial reliable evidence of Aliyev's guilt.
The activist said that he is being persecuted for political reasons because of his PFPA political activities". 51 The lawyer did not reveal the details of the case having referred to the confidentiality agreement but indicated that he would file an appeal.
It should be noted that Elkhan Aliyev has been repeatedly subjected to administrative arrests.
Thus, in October 2021, he was detained for 15 days on charges of disobeying the police, and in December of that year, Aliyev was arrested for 20 days for participating in a rally.
On 19 March 2022, Elkhan Aliyev was arrested for a 30-day period on charges of disobeying police and hooliganism.
Following his arrest, Aliyev claimed that 2,500 manat ($1,500) had gone missing from his car having suspected the law enforcement officials in the matter.
While in the detention center he went on a hunger strike to protest against his arrest and the money disappearance.
